Caption: Last Saturday morning, a total estimate of 300 people turned out to aid in the search for Jackie Johns in the 15-mile search area north of Nixa. They gathered at the Nixa Livestock Sales Barn and Cafe, where Johns had worked. Pictures here is Gerry Perry of the Christians County Sheriff’s Department asking questions in an effort to gain any type of information which might be helpful in the case. Johns’ body was recovered Saturday morning from Lake Springfield, while searchers gathered in Nixa.

Murder Investigation Stepped Up By Lawmen

Christian County Sheriff Dwight McNiel and several other area lawmen have spent the past week investigating all possible leads to find some clue which will lead to the arrest of the person or persons responsible for the June 17 death of Jackie Johns of Nixa. Several possible suspects have been questioned but no arrests have been made.

Four days of intensive search efforts by hundreds of people ended last Saturday morning when the nude body of Johns was found in Lake Springfield by two fishermen. Apparent cause of death was a blow to the head.

Johns, a 20-year-old Nixa woman, had been reported missing June 18 after her car was found abandoned north of Nixa on Highway 160, approximately a mile from the Nixa Livestock Sales Barn and Cafe where she had been employed. Johns had last been seen shortly after 11 p.m. Monday at a convenience store where she had gone after leaving work.

Johns’ clothing purse and car keys were found in the vehicle, as well as blood stains in the back seat. An all-out search effort was launched by the Christian County Sheriff’s Department around the area where Johns car was found.

Evidence later discovered in the Johns’ vehicle led law enforcement officers to believe the possibility of more than one suspect in the case.

A reward fund opened at the Nixa Bank contained over $13,000 as of Tuesday, according to Sheriff Dwight McNiel. He also said this reward was of a different kind. Usually, he said, a reward is given for the arrest and conviction, but this one was being offered for the arrest and prosecution.

McNiel said they have joint jurisdiction in the Johns case, and that is a usually situation with a normal murder case, wherever the body is located is where the case goes, which would have been Springfield, since the body was found in Greene County. The Springfield Police Department, Division of Dog and Crime Control, said the Missouri State Highway Patrol have all assigned several full-time investigators to the case, McNiel said. He added that Springfield police had not only assigned detectives, but also clerical and crime analysis systems personnel, and all are stationed at the Christian County courthouse, where they have had their entire operation since the beginning.

McNiel said they are also being assisted by special agents of the FBI, and right now are conducting an around-the-clock intense investigation. The FBI is also conducting a criminal murder.

As of Monday, an in-house polygraph and operator were installed in the court house as an aid in this case.

In cases such as this, Mr. McNiel said, there are mounds of details to be worked through, and it is very intense. There have been dozens of people giving evidence, and dozens more taking the polygraph test. They are leaving nothing unturned, he said, nothing unchecked and are assigning each and every lead that comes through.

McNiel says he feels this investigation is by far and away the most monumental task in the history of the county, and the largest joint effort, with literally every organization in the state involved.

With determination, he added, that they were going to bring this case to a close.

Sheriff Department Continues Investigation In Murder Case

Investigations are continuing in Christian County at the same pace they were begun, Sheriff Dwight McNiel said in conjuction with the homicide of Jackie Johns, the 20-year-ole Nixa resident whose nude body was found in Lake Springfield June 22, ending an intensive four-day search for the girl after he abandoned car was found north of Nixa.

Sheriff McNiel said interviews are still being conducted on a daily basis by investigating officers from the Christian County Sheriff’s Department, Springfield Police Department, Missouri Highway Patrol, and Missouri Division of Drug and Crime Control. McNiel added that in addition to these, during the last week, they employed the resources of the Mid-States Organized Crime Information Center, which is headquartered in  Springfield. McNiel said that this branch of the Department of Justice provides analytical and equipment support for law enforcement officers in a dour-state region, They will be helping to coordinate, chart and analyze the paper flow being generated by this investigation.

“We are taking a methodical and thorough approach in this investigation.” Sheriff McNiel said.

Statements are still being taken, interviews conducted, and polygraph tests taken in connection with the case. McNiel said hundreds of people in and out of the area have been interviewed at this point, and he stressed again that they will continue with the same method of investigation they began with.

Sheriff McNiel concluded by saying that their focus has narrowed somewhat but actual leads and evidence cannot be released.

Caption: Last Friday afternoon, a press conference was called in the Christian County Sheriff’s Office to announce the calling of a grand jury into the homicide case of Jackie Johns. County Prosecutor Tim McCormick made the announcement. Others present were Sgt. Burk and Lt. Worsham of the Springfield Police Department, Christian County Sheriff Dwight McNiel, and Greene County Prosecutor Tom Mountjoy

Grand Jury Called In Johns Case

Christian County Prosecutor Tim McCormick announced last Friday afternoon during a press conference that a grand jury would be called, possibly before the end of the year, on the homicide investigation of Jackie Johns, the young Nixa woman whose nude body was found in Lake Springfield June 22, ending an extensive four-day search for the girl after her abandoned car was found north of Nixa.

McCormick stated that the investigation was going into its fourth month on both sides of the county lines (Christian and Greene) and that he and Tom Mountjoy, Greene County Prosecutor, had monitored the investigation as it progressed with state, federal, county and city officers amassing volumes of evidence, McCormick said that without exaggerating, it was one of the most exhaustive cases to date. He added that questions still remained unanswered, and they would be greatly aided by the impaneling of a grand jury.

McCormick said that he had conferred with Circuit Court Judge Clifford Crouch, and that early last week it had been decided that further investigation should take place in Christian County. He said that the formal request had been presented Friday morning, and that the request to hear evidence in the Johns case had been granted.

The staggering quantity of evidence in the case was pointed out by McCormick, as he said that all that remained was the follow-up work, and officers had been asked to complete their case summary by October 31. A detailed review will be given to Judge Crouch at that time, when they need to make the necessary arrangements. The investigation will continue on both sides of the county live, and Mountjoy will remain active in the case.

McCormick said that because the body was found in Greene County, it did not prohibit the calling of a grand jury in Christina County.

McCormick would not speculate on how close they were to arriving at a conclusion to the case.

McCormick said that certain tools were available to a grand jury that were not available to an individual, and it would not speculate on what it might possibly accomplish, and he could give no details on the evidence.

Others present besides McCormick and Mountjoy, at last Friday’s press conference, were Christian County Sheriff Dwight McNiel, Sgt., Burl and Lieutenant Worsham of the Springfield Police Department.

The calling of a grand jury in Christian County is the first in McCormick’s memory. And he stated that they did not anticipate using the grand jury on other cases at this time

Carnahan Returning To County

Gerald Carnahan, 27, of Springfield, was arrested October 30 at Los Angeles International Airport on a Christian County warrant for felony tampering with evidence, according to Christian County Sheriff Dwight McNiel.

Carnahan was arrested by Los Angeles police officers while waiting to board a flight to Taipan, Taiwan. He was held in the Los Angeles Police Department jail on $500,000 bond. Sheriff McNiel and Chief Deputy Nick Corsentino left last Tuesday for Los Angeles to return Carnahan to Christian County. McNiel said they would return Wednesday night or Thursday.

McNiel said that Carnahan was wanted in connection with a homicide investigation in the county, and that Carnahan had voluntarily waived extradition.

October 30,  Sheriff McNiel learned that Carnahan had taken a pre-dawn flight from Springfield Regional Airport and intended to leave the state, and possibly the country. McNiel then contacted the Federal Bureau of Investigation for an arrest. The FB contacted the Los Angeles police concerning the arrest of Carnahan before he could board the flight to Taiwan.

Following the notification of the FBI, NcNiel traveled to Taney County to obtain Judge Clifford Crouch’s signature for the warrant. Christian County Associate Circuit Judge Anthony McConnell was unavailable at that time. Law enforcement officials then sent notification of the warrant by computer to California, and Carnahan was arrested while waiting for a boarding pass.

The only homicide investigation currently underway in Christian County is that of 20-year-old Jackie Johns of Nixa, who disappeared June 17. Her nude body was found four days later in Lake Springfield.

Carnahan was among those questioned during the investigation, but Sheriff McNiel did not make a direct connection with that and Carnahan’s arrest.

Grand Jury Will Hear 18 Cases Before Investigating Johns’ Murder

December 10, a grand jury was convened in the Christian County Courthouse to hear evidence in the Jackie Johns homicide investigation. Of the 38 jurors able to be contacted, all but 12 were eliminated. Those jurors are Audrey Clinton, Macanna Murray, Delton Cotton, Roger Bolin, Jeanette McCauley, Virginia Day, Curtis Peterson, Earl Bilyeu, Jewell Greene, Jeannie Coffer, Erna Kastendieck, and Earl Bradford.

Earl Bilyeu is serving as foreman of the grand jury, and Joe Layton is the bailiff. Richard D. Lamb is the official court reporter, with Jean Brown serving as deputy court reporter.

In jury instruction form Circuit Court Judge Clifford Crouch, it is written that the grand jury will “review evidence and summon witnesses in regard to any and all crimes directly or indirectly related to the abduction and death of Ms. Johns.”

Before beginning on the Johns case, the grand jury will be hearing 18 other unsolved Christian County cases. They include the theft of a Snapper mower from the Chadwick cemetery in January 1985; the disposal of stolen property, a camper shell from Custom Craft in Rogersville, in April 1985; the theft of lumber on or about April 20, 1985 and a related series of thefts; circumstances surrounding the sale of advertising and phone listings for a Christian County phone book in 1983 and 1984; a burglary and theft at Billings on or about January 2, 1985; a motor vehicle accident on or about May 27, 1984; a series of thefts and embezzlement over a period of three years, ending Nov. 15, 1985; thefts of food supplies between Oct,. 10, 1984 and Sept,. 7, 1985; the passing of bad checks to Christian County Gas on or about Oct. 25, 1983;

The defrauding of a secured creditor between Aug. 1980 and May 1984 by the sale of mortgaged cattle; the escape of a juvenile from Delmina Woods and crimes connected to the escape on or about July 19, 1985; unlawful sexual contact with a minor on or about June 7, 1985; the assault at a bar in Ozark on or about Aug. 27, 1985; review evidence in regard to the making of false statements to Ozark police officers involving a homicide investigation in Christian County on or about June 24, 1985; the unlawful sexual contact with a minor between Nov. 1982 and Nov. 1985; and the embezzlement of insurance premiums between Jan. 1, 1984 and Dec. 1, 1986.

The grand jury has the power to investigate criminal activity be compelling the attendance of witnesses and requiring them to testify in secret. This is a power that neither the prosecuting attorney nor regular law enforcement agencies possess. The chief value of a grand jury lies in those cases which may cause great public injury and which are beyond the investigative capabilities of the regular law enforcement agencies.

It further states in Judge Crouch’s instructions to the jury that there is no limit to the scope of their investigation; no one had immunity from their inquiry. Grand jury is an independent area of the court, representing the state of Missouri in Christian County, and they are responsible to no controlling authority, except to perform duties as chosen citizens of the county and state in accordance to their oath.

All grand jury meetings are conducted in private at a time selected by the jurors. No one is admitted except the members of the grand jury, the prosecuting attorney and the assistants, and the witnesses. Only one witness is permitted in the grand jury room at one time.

No one is allowed to disclose the names of witnesses nor any proceedings of the grand jury. And they cannot disclose the fact of an indictment having been found against a person for a felony until the defendant has been arrested.

Nine jurors must agree to return an indictment.

The grand jury’s term of service cannot extend beyond February 3, when the October term ends. Their service will expire on that date, or earlier if discharged by the court.

Murder Investigations Taxing Sheriff Dept.

There are currently four unsolved murders in Christian County, three happening  within the last two months, and all happening in the Western part of the county. Investigations into theses incidents, along with routine thefts, burglaries and other infringements of the law, are leaving the Christian County Sheriff’s Department overworked and understaffed. Sheriff Dwight McNiel intends to request the Christian County Commission to allocate additional funds for more law enforcement officials for the county. In the meantime, the Sheriff and his deputies putting all they’ve got into solving of all cases in Christian County.

Sheriff McNiel said there was nothing to comment on and nothing new in the homicides involving Jim Sullivan, Cheryl Osborn, and Michael Sparks, although the investigations are continuing.

Sullivan and Osborn were murdered in an execution-style killing January 2 on a farm southwest of Billings. Sparks’ body was found in the James River December 22, having been dumped there after being shot three times in the chest.

All three homicides follow common ties, according to Sheriff McNiel, because of the similarities. And all have been speculated to be drug related. Drug paraphernalia, as well as drugs and chemicals, were found on the farm where Sullivan and Osborn’s bodies were found.

All three subjects were known to law enforcement officials.

Despite the recent rash of drug-related homicides in the western portion of Christian County, Sheriff McNiel stated that he does not believe there is any more of a drug problem in Christian County than there has ever been. He said nothing the statistics show would indicate that such would be true.

With western Christian County so close to the Greene County line and Springfield, some have speculated that Christian County has become a dumping ground for bodies., Both Sullivan and Osborn resided in Springfield, and Sparks was visiting friends there.

The fourth outstanding homicide in Christian County is the Jackie Johns case. Law enforcement officials have been working on the case since June, Johns’ body was discovered June 22 in Lake Springfield, following a four-day intensive search for the girl,.  The Christian County Grand Jury is presently working on the case, and has until February 3, at which time their term will expire. It is not known whether and indictment will be handed down at that time.

Will Be Held In Lexington, Mo.

Carnahan Trial Is Monday

The trial of Gerald Carnahan, 27, of Springfield, is set to begin Next Monday morning in Lexington in Lafayette County on a change of venue form Christian County. The charge against Carnahan is felony tampering with evidence and stem from Carnahan being accused of lying to Sheriff Dwight McNiel June 24, 1985 during the investigation into the disappearance of Jackie Johns, 20, of Nixa.

Johns disappeared June  17, 1985, and her body was found five days later in Lake Springfield.

On Nov. 17, of this year, a motion to quash the indictment for prosecutorial misconduct was filed in Christian County Circuit Court. The motion, filed by Carnahan’s attorneys, Jack Yocum and William Wood, stated that the prosecutor’s misconduct through witness harassment, improper comments and inflammatory questions in the presence of a grand jury biased that jury against the defendant. No answer has been filed.

Twenty-one witnesses from Christian County have been subpoenaed for the first day of Carnahan’s trial, Dec. 8. Many more subpoenas are being issued for Dec. 10. The trial is to run through Dec. 5, 6, 20, 11, and 12

More than 24 years after Jackie Johns’ body was found in Lake Springfield and nearly two years after the arrest of her long-suspected alleged killer, Gerald Carnahan will face a jury. Greene County Prosecutor Darrell Moore’s office said St. Louis County Circuit Judge Michael T. Jamison scheduled a trial for July 27, 2009, in the first-degree murder case against Carnahan during a motions hearing Oct. 2.  The case was moved to Clayton in St. Louis County in June following a written request by both Moore and Carnahan’s attorney, Joe Passanise. Jamison also scheduled an evidentiary hearing for Dec. 5.  Evidence has been the cornerstone of Moore’s case against Carnahan since the investigation was re-opened by the Missouri State Highway Patrol. According to the probable cause statement filed by MSHP, Johns' autopsy revealed she had died from blunt force trauma to the head and that evidence also suggested she was sexually assaulted. A DNA profile from an unknown subject emerged from a vaginal swab taken from the victim at the time of the crime. Troopers executed a search warrant on Carnahan Aug. 8, 2007, and obtained “several buccal cell swabs” from him. The crime lab in Jefferson City then “obtained a DNA profile for Carnahan” from that swab—upon comparison, the two profiles matched. Jackie Johns and was last seen at approximately 11 p.m., June 17, 1985, in the Nixa 7-11 Market. She was reported missing by her employer, Jerry Estes, Nixa Livestock Barn and Cafe. Her car was located on U.S. 160 Highway, one mile north of the sale barn. Her clothing, purse and keys were found inside the car, as well as blood stains in the back seat. After four days of searching by hundreds of law enforcement personnel and volunteers, Johns' nude body was discovered June 22 in Lake Springfield by two fishermen. Her apparent cause of death was listed as a blow to the head. Several witnesses, including Carnahan, were interviewed in the past 22 years, according to the statement. One witnessed even quoted Carnahan as saying “Yeah, I know, I did it, but they are so incompetent, they can't prove it.” If convicted, Carnahan faces death or life imprisonment for the murder charges and 10 to 30 years on the rape charge.
