Walter Barton found guilty, death penalty recommended

From our staff

It was the fifth time Walter Barton went to trial and it was the third time that a jury found him guilty of killing 81-year-old Gladys Kuehler in the first degree. Two attempts failed in mistrials and two convictions were set aside. This time the verdict will stick. Christian County Prosecutor Ron Cleek said.

“The trial was clean,” he said, “We went through the (previous) transcripts and avoided any problems along those lines.”

Cleek, who was assisted by state prosecutor, Mike Bradley, said the trial, held in Harrisonville on a change of venue, went better than he expected.

“It went great,” he said. “Mike Bradley and I worked well together.”

In reaching the verdict, the Cass County jury deliberated for two hours and 20 minutes on the 1991 murder of Kuehler who managed the Riverview Mobile Home Park that now sits in Ozark’s Finley River Neighborhood District slated for redevelopment by the city.

In the second - penalty - phase of the trial, the jury recommended death. Cleek said prosecutors were able to introduce Barton’s prior criminal history during the penalty phase.

According to information from Cleek, the 50-year-old Barton has spent most of his life behind bars. He was incarcerated for assaulting a convenience store clerk in the 70s. She later died of injuries sustained in that attack, but just after the conviction. Barton again assaulted another woman and returned to prison in 1984. He was released in 1989 and two years later killed Barton.

Supreme Court upholds man’s death sentence

Chris J. Cluck Headliner News

An Ozark man will still receive the death penalty for the 1991 stabbing of a trailer park manager after the Missouri Supreme Court upheld the sentence Dec. 18.

Walter Barton, 51, will remain on death row after the supreme court voted 4-3 to uphold the sentence of a March 2006 Cass County conviction of first-degree murder.

The Cass County conviction was the fifth trial for Barton who was arrested by Ozark Police Oct.9, 1991, when the mutilated body of 81-year-old Gladys Kuehler was found in her trailer.

A coroner’s report confirmed that Kuehler had been stabbed more than 50 times and she had been sexually assaulted.

Barton was a former resident of the trailer park Kuehler was managing, formerly located in the Finley River Redevelopment Area.

Justice Stephen J. Limbaugh, Jr., wrote the affirming opinion with judges William Price, Mary Russel and special judge David Evans concurring. Dissenting opinion was written by judge Michael Wolff with Chief Justice Laura Stith and judge Richard Teitelman concurring.

Limbaugh’s affirmation said the evidence leading to the Cass County trial was more than enough to uphold the conviction and death sentence.

Judge Patricia Breckenridge did not participate.
