Second Degree Murder Charge Filed For Hit And Run Incident. by Michael J. Hill

Christian County Prosecuting Attorney Tim McCormick filed a charge of Second-Degree Murder of Tuesday, March 16, against Gary R. Van Gunde, 32 in connection with the death of James Medlin, 57, Billings.

Van Gunde was arrested Friday, March 12, by the Leavenworth County, Kansas Sheriff’s Office, and held on a warrant charging him with a Class A. felony of First-Degree Assault.

The charges stemmed from an incident that occurred on Monday, March 8. shortly before midnight, when a car, reportedly driven by Van Gunde, ran down Medlin outside a Billings tavern.

According to accounts provided by Christian County Sheriff Buff Lamb, Chief Deputy Dwight McNiel and McCormick, Medlin was a spectator at a pool game between Van Gunde and another man that developed into an argument.

Several people left the building, then Van Gunde and his two companions, Jackie L. Forrester, 23, Marionville, and Steven A. Smith, 26, Lampe, got into Van Gunde’s car.

The driver of the car reportedly made a U-turn across the street and struck Medlin, then sped from the scene.

Medlin was taken to St. John’s Regional Health Center, where he remained in critical condition until his death about 7 a.m. Tuesday, March 16.

Van Gunde’s car was chased by Billings Police squad car south on Highway 13, for about four miles, until it stopped and the three men fled on foot.

The Sheriff’s Office and the State Highway Patrol were notified and joined in the search for the rest of the night and all day, Tuesday, March 9.

The car, a white, late-model Plymouth Volare, was towed to Ozark, where it was searched later in the day.

Meanwhile, citizens living near Bluebird Point, on Table Rock Lake, near Lampe, reported to the Stone County Sheriff’s Office that a car had been driven into the water there,

A license plate found at the scene was traced back to a Dodge Polara station wagon that had been stolen about one and a half miles from the point at which the three men had abandoned Van Gunde’s car.

Residents gave a description of a car with Illinois license plates that had been seen in the area, and Smith, whose car matched the description, was arrested at about 11:00 p.m. that night in Stone County.

Warrants had been issued for Van Gunde and Forrester, both charged with the Class A. felony of First-Degree Assault.

Forrester, accompanied by his attorney, surrendered to the Christian County Sheriff’s Office late Tuesday afternoon, and was booked on that charge.

It was not known how Van Gunde got to Leavenworth County. McNiel would only say, “We are speculating that he was driven by another party We are investigating the possibility of filing charges against that person.”

Forrester entered a plea of not guilty at his arraignment on the Assault Charge, Wednesday, March 10. A date of April 12 was set for a preliminary hearing, and bet was set at $50,000.

Forrester posted the bond on Friday, March 12, and was released, according to records in Division II, Circuit Court.

Smith was arraigned on a charge of stealing, a Class C felony, on Thursday, March 11. His preliminary hearing was set for April 8. He remained in jail on a $15,000 bond.

McCormick said late Tuesday that he had begun extradition proceedings against Van Gunde by filing a Requisition for Governor’s Warrant on the murder charge.. Van Gunde was being held on the earlier Assault Warrant in the Leavenworth County jail.

Death of Lillie Medlin - Dr. F. H. Brown Charged With Causing Girl’s Death

Billings, Mo., May 18 - As the result of an investigation into the death of Lillie Medlin, who passed away in St. John’s Hospital in Springfield May 12, Dr. Fred H. Brown, a physician here, was arrested today on a charge of manslaughter. It is alleged that Dr. Brown caused the girl’s death by an operation which he is said to have performed on her. It is claimed that the operation took place May 5. The young woman was removed from this city to Springfield May 7, and it is said was placed in a rooming house on College Street by the doctor but was later removed from there to Phillips and Guy streets because a friend of the girl resided near by. When she reached the latter place, it is said, her condition was so serious that she was taken to the home of a friend and put to bed, remaining there until she was taken to the hospital where she died. Dr. Brown arranged for bond in the sum of $2,000 and was released shortly after his arrest. He stoutly declares he is innocent. A preliminary examination has been waived and the case will come up at the August term of the circuit court. Lillie Medlin was about 23 years of age and was the daughter of J. W. Medlin, a liveryman of this city. There is some doubt as to who is responsible for her alleged condition, but it is thought that this will be developed in time. Dr. Brown made a statement tonight declaring that he is innocent of the crime of which he is accused and will be able to show it at the proper time. “It is only a scheme of my enemies to try and ruin me if possible,” said Dr. Brown, “And I will be able to prove to the world that there is nothing in the charge, but time alone will tell the tale. I do not fear the result of this charge although I fully realize that is a very grave one. I will be exonerated at the trial of the case.” - Springfield Republican.
