Local businessman urges residents to help family
From our staff
Steve Branstetter, owner of Bumstead’s Restaurant in Nixa and Ozark, held a benefit last week for the family of Levi Ricketts. The 15-year-old Ozark High School student died March 30 and his single mother, Linda, was left with funeral expenses.
Branstetter said the event raised about $1,000, but he wants to do more.
“He was a good kid - a straight-a student,” Branstetter said. “His mother is single and all we are trying to do is pay off her funeral expenses.”
Branstetter said anyone wanting to help out can donate to the Kevin Ricketts Memorial Fund, call Branstetter at (417) 848-5293 or mail donations to Bumsteads, 1528 N. Main St, Nixa 65721.
Branstetter said that losing a child and then having to make a payment on the funeral every month is just too much to endure.
“I just want to help if I can,” he said, “you can’t just take all the time, you have to give a little bit.”

Ozark man charged in death of stepson
Jeremy Bryan was drunk when ATV flipped, killing youngster
Ryan Bowling Headliner News
Douglas County Prosecutor Christopher Swatosh arrested Jeremy Bryan, Ozark Dec. 5 on charges of involuntary manslaughter, a class D felony, in the death of Nicholas Evan Riley, 10, his stepson, and child endangerment for injuring Chase Bryan, 3, his son, on private property near Ava. Court documents allege Jeremy Bryan was driving an all-terrain vehicle under the influence of alcohol when it overturned, crushing Nicholas and throwing Chase.
Nicholas, whose neck was broken by the ATV, was taken directly to a funeral home in Ava after the accident. Jeremy and Chase Bryan were taken to Cox South in Springfield and treated for minor injuries. Jeremy Bryan initially refused a breathalyzer at the hospital, but medical records show that two hours after the accident, his blood alcohol content was .131. The legal limit for the state of Missouri is .08.
“It makes me angry,” Rhonda Riley, Nick’s aunt said. “It makes me wonder how many times he’s been intoxicated and taken Nick out.”
Jeremy Bryan faces up to a four-year prison sentence if convicted or pleads guilty. According to state law, a person commits second-degree involuntary manslaughter if “he acts with criminal negligence to cause the death of any person.”
Nick’s father, Charles Riley, Springfield, has filed wrongful death suits against Jeremy Bryan, the husband of Charles ex-wife, Tammy and the Evans, Tammy’s parents. A hearing for that case has also yet to be scheduled as of press time.
According to information from Children’s Mercy Hospital, between 1982 and 2003, more than 1,800 children were killed in ATV crashed, including 111 in 2003 alone. That same year, 38,500 children were treated in emergency rooms for ATV related injuries, many serious and some fatal.
Operating an ATV under the influence, as with any other motor vehicle, greatly increases the likelihood of tragedy.
“Nick always loved ATVs”, Riley said. “We’d always take him around slowly in the yard. But, we don’t have a farm like in Ava.”
According to Greene County court documents, Jeremy was on parole for an unrelated drug charge in Greene County at the time of the accident, Sept. 11. Driving under the influence of alcohol violated his parole and a hearing for that offense has been set for Feb. 9. A hearing for the manslaughter and child endangerment charges has not been set.
Riley said that initially, however, Jeremy had lied to the family, saying he was driving carefully, slowly, and had not been drinking.
“I didn’t find out that he had been drinking until the prosecutor said it on television,” Riley said. “We were led to believe this was an accident, that he was driving very carefully and slowly and that Nick was crush because they were going so slow. Jeremy said that Nick and Chase would have been thrown further from the ATV if they had been driving faster, and that Nick might have lived, but that wasn’t true.”
The tragic reality for Riley and the family of Nick begs even more questions, however regarding the safety of children on ATVs - if Jeremy had not been intoxicated, would the ATV have flipped regardless? What if they were wearing a helmet? Or a seat belt? Just how safe are children on an ATV?
According to Riley, the Douglas County prosecutor said in his television interview that if Nick had been wearing a seatbelt, he might have lived. Riley also said that the type of ATV they were riding did indeed have seatbelts, but they were not fastened.
Dennis Tomlin, owner of TRS Cycle in Nixa, which specialized in ATV repair work, said the biggest issue with child safety on ATVs isn’t so much seatbelts, which can help, but the overall size of the vehicle they’re riding and an inability to control it.
”The size of the four-wheeler is the main issue,” Tomlin said. “It’s recommended that anyone under 16 should ride between a 5occ to 125cc. It’s a safety issue doe to the experience of the child.”
Tomlin said the larger the vehicle and engine, the harder it is to control and the easier it is to flip. While Nicholas wasn’t driving when the ATV overturned, many kids are driving them when they shouldn’t be.
“Anything over 200cc has a warning label on it that children under 16 shouldn’t be driving it,” Tomlin said. “Most kids wasn’t to drive a sport ATV and all of them ate 200cc and up. Most kids are driving bigger ATVs than they should be. Most kids are driving what they shouldn’t be driving.”
Driving an ATV at an early age has its risks, but riding as a passenger, in the case of Nick, both he and 3-year-old brother Chase were riding beside Jeremy, can be equally dangerous.
“Most ATV’s say no passenger should be on it.” Tomlin said. “It says it on a generic symbol on the seat cover or back fender - ‘Warning: never ride as a passenger.’ That is one thing that is neglected by children. They do not read the signs.”
Tomlin offered up a telling analogy concerning the dangers of ATVs, which aren’t so different than operating a gun.
“I look at it as the same thing as a gun,” Tomlin said. “It’s not the gun that’s hurting someone, it’s the operator of the gun, or the ATV in this case.”
While seatbelts will keep a rider connected to the ATV should it overturn, that’s not the area of most concern for Tomlin or Riley. Instead, there should be more emphasis on wearing helmets, perhaps even laws requiring it.”
“You should at least wear a helmet to prevent a head injury,” Tomlin said. “That’s the most important part of the body.”
Riley agrees. She said she gets upset when she thinks about the two little boys riding that fast without a helmet to protect them,, especially when 3-year-old Chase reportedly told his father to slow down, but he wouldn’t.
“ATV’s are really dangerous,” Riley said. “There should be a law to wear a helmet at the least, and an age limit that shouldn’t let a 3-year-old ride.”
Advocates for more highly regulated laws and warnings for children have been lobbying for action since ATVs became popular in the early 1980s.
On behalf of the American Academy of Pediatrics, Dr. Denise Down, chief of Section of Injury Prevention at Children’s Mercy Hospitals and Clinics, testified before a Congressional committee in July about the dangers all-terrain vehicles pose to children.
“I know that when the (ambulance) crew tells us ‘12 year-old in an ATV accident’, it is more likely that our team will soon be treating a traumatized child who is severely and graphically injured,” Down said in her oral testimony.
Down spoke July 13 before a joint meeting of the House of Representative’s Subcommittee on National Parks and Subcommittee on Forests and Forest Health. She served as representative for the American Academy of Pediatrics as a member of its Committee on Injury, Poison and Violence Prevention.
Dowd said Children’s Mercy is on tract to treat a record number of ATV-related injuries this year. She said that from January to July, Children’s Mercy alone treated 33 children with severe injuries while driving or riding as a passenger on an ATV. Most could be prevented, she believes, is the state and federal government would become more active with its regulations.
“If an infectious disease caused this level of death and disability, the federal government would spend millions of dollars toward curing it.” Down said. “In the case of ATVs, however, the government has done virtually nothing over the past 20 years.
The subcommittee is considering regulations for the use of ATVs on federal lands. Dowd said that this would help be a model for state and local governments to limit ATV use by children. Among the recommendations by the AAT are:
*Children under 16 should not operate ATVs.”
*ATV use should be banned on paved roads in public lands.
Riley said that Nick’s birthday is the 17th of this month. He would have been 11.
“I miss his smile. He had a really sweet smile, and a contagious giggle. He always had a hug for you - I likes that he hadn’t grown out of hugs yet,” Riley said.
Many things might have prevented Nick’s death - helmets, seatbelts, or laws preventing his riding. To the dismay of Riley, Dowd and many others, none of these are mandatory and all might have helped.
“I don’t hate Jeremy for what he did because everyone makes mistakes. But this wasn’t his first mistake. This time it involves other people. It could’ve been prevented,” Riley said.
